Privacy Policy

1. Introduction

This Privacy Policy defines the rules for the processing and protection of personal data provided by Users (hereinafter referred to as the “User”) in connection with the use of the marketplace platform for local producers and artisans operated by Spot Guide Ltd.

The controller of personal data is Spot Guide Ltd., with its registered office at 3 Hesketh Road, Ribbleton, Preston, PR2 6NS, United Kingdom (hereinafter referred to as the “Controller”).

3. Nature of the Marketplace Platform

The platform enables local producers and artisans to present and sell their products. The Controller is not a party to transactions concluded between Users and bears no responsibility for listings, the sales process, return policies, order cancellations, or other aspects of sellers’ activities on the platform.

4. Principles of Personal Data Processing

  1. Personal data is processed in accordance with applicable laws, including European Union regulations and relevant national laws outside the EU.
  2. The Controller ensures the confidentiality, integrity, and availability of Users’ personal data.
  3. Personal data is collected solely for specified purposes and stored no longer than necessary.

5. Scope, Purpose, and Legal Basis of Data Processing

  1. The Controller processes personal data collected during platform registration, use of services, newsletter subscriptions, purchases, product reviews, and similar activities.
  2. Personal data may be used to fulfil orders, personalize offers, analyze website traffic, conduct direct marketing, and for other purposes related to operating the marketplace.
  3. The legal basis for processing personal data includes the User’s consent, performance of a contract to which the User is a party, or the Controller’s legitimate interests.

6. Right of Withdrawal

Sellers offering products on the platform are required to comply with consumer withdrawal regulations. If, as a Buyer, you are not satisfied with a purchased item, you have the right to withdraw from the contract under the following conditions:

  1. Withdrawal period: You must notify the Seller within 14 days of receiving the item of your intention to withdraw from the contract. You then have an additional 14 days to return the goods.
  2. Refund: After receiving the item in an undamaged condition, the Seller is obliged to refund the purchase amount via the credit card used for payment. If you prefer a bank transfer or MobilePay, inform the Seller when submitting your request.
  3. Return shipping costs: When exercising the right of withdrawal, the Buyer bears the cost of return shipping.
  4. Return packaging: The returned item must be properly packaged. If in doubt, we recommend keeping the original packaging.

7. User Rights

Regardless of place of residence, the User has the right to:

  1. access their personal data,
  2. rectify their data,
  3. erase their data,
  4. restrict processing,
  5. object to processing,
  6. data portability,
  7. lodge a complaint with a competent supervisory authority.

8. Transfer of Data Outside the EEA

The Controller may transfer Users’ personal data outside the European Economic Area (EEA) in accordance with applicable law, ensuring an adequate level of data protection.

9. Security of Personal Data

The Controller applies appropriate technical and organizational measures to ensure the protection of processed personal data.

Acceptable Use Policy (AUP)

  1. Introduction: This Acceptable Use Policy (“AUP”) defines the rules and conditions for using the services and products offered by Spot Guide Ltd. Every user, customer, or person using our services is required to comply with this AUP.

  2. Prohibited Activities: Users are required to use Spot Guide Ltd. services in a lawful and ethical manner. The following activities are prohibited:

    • Sending spam or unsolicited communications.

    • Attempts to hack, perform DDoS attacks, or otherwise disrupt services.

    • Distributing content involving hate, discrimination, violence, or pornography.

    • Infringing copyrights or intellectual property rights.

  3. Prohibited Industries and Goods: Spot Guide Ltd. reserves the right to refuse services to entities operating in certain industries or trading specific goods, including:

    • Illegal substances, drugs, and prescription medicines without proper authorization.

    • Weapons, ammunition, and explosive materials.

    • Sexual services, pornography, and adult materials.

    • Gambling and games of chance without required licenses.
